Hits Surf Terms Of Service

This User Agreement (“Agreement”) is a contract between you and Hits Surf. and applies to your use of the Hits Surf’s services and any related products available through Hits Surf Internet Servers (collectively the “Service”). If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our Services.

By clicking on the “Register Me” button located in the Hits Surf signup form you agree to be bound by all the terms of this Membership Agreement including the privacy statement located elsewhere.

Updates To This Agreement

This Agreement may be modified by Hits Surf at any time and without notice to the membership. Member accepts that by continuing use of the Hits Surf web site any modification of this agreement is enforcable. If the Member objects to any modification the only remedy for the member is to terminate their account. The Frequently Asked Questions page has several ways a member can delete their account.

Membership Requirements

To maintain a Hits Surf Membership a member must meet the following requirements. Hits Surf reserves the right to terminate the Membership of anyone who fails to meet these requirements on an ongoing basis:

• Only One Membership Account Per Individual
• Only One Individual Per Membership Account
• Only One Membership Account Per E-mail Address
• Only One Membership Account Per Computer
• Any duplicate accounts are subject to cancellation with forfeiture of all credits, referrals, and cash held in such accounts
• No transfer of any credits and/or referrals between accounts or to any third party unless approved by the admin of Hits Surf
• Credits and Referrals cannot be transferred by Member upon death
• Your User Name/Member ID, Password, and Account Data are personal to you and are not transferable
• You may not allow anyone else to use Your password or account
• You may not use anyone else’s password or account
• You are responsible for keeping Your password secret
• Hits Surf is not liable for any loss or damages caused by any disclosure of your password or account
• You may only create an account for yourself and may not establish an account on the behalf or for anyone else
• To the full extent allowed by applicable law, Hits Surf at its sole discretion and for any or no reason at all may refuse to accept applications for membership and may terminate any Members without prior notice, particularly including, but not limited to:
  1. any violation of any provision of this Membership Agreement
  2. aiding in or promoting circumvention of Hits Surf
  3. acting against the business interests or reputation of Hits Surf
  4. otherwise acting in a severely or substantially unlawful manner in relationship to Hits Surf, the Hits Surf Web site or the Service
  5. material breach of our spamming policy
  6. any other reason at the discretion of the Hits Surf Admin
• Hits Surf may terminate a Member account if they are found to be under the age of 18 years old
• Advertising resources (Full Page Ads, Banner Ads, Text Ads) found to violate these terms will have the resource removed
  1. Content with the following will be removed:
     • Framebreakers
     • Adult
     • Racism
     • Warez
     • illegal
     • Multiple and/or Full screen pop ups/under/exit ads and Popup Rotators
     • Redirected URLs (URLs the use the META REFRESH tag)
     • Gambling or Gambling Related
     • audio
     • video
     • attempting to initiate a download
     • Hidden IFrames
     • Page not found errors
     • Investment
     • HYIP
     • income claims
     • Blind Lead Capture Pages (Email Capture with no link back to main program/contact info/privacy policy/Terms of Service)
     • Non-Registered Charities
     • Non-English Sites
     • Investment surf programs
     • Pay to Promote Sites (PTP, PTR, PTC,etc.)
     • Surfing Links in attempt to earn credits from another exchange
     • any other unsuitable websites
     • All sites are subject to the approval and discretion of the Hits Surf Admin
  2. Members who post non-family safe websites will have their pages removed and all credits assigned to the page may be forfeited
  3. Hits Surf Referral URLs
  4. Banner images must display correctly and be of the 468 x 60 pixel size
  5. Banner Images must match the linked URL content
  6. Banner URLs must meet all site approval requirements
  7. Textual Text must match the linked URL content – No “You Won” and there is nothing to win for example
  8. Textual link URLs must meet all site approval requirements

Hits Surf Credits

A “Hits Surf Credit” (ie; full Page Display, Banner Ad, Text Ad Credits) do have a monetary cash value based on the membership page offers in respect to commissions earnable. The Hits Surf website may offer at its discretion, to buy credits from its members for cash (US currency). The price paid for credits will vary and will be listed on the Hits Surf Members Area web site.

Eligibility for Credits

Credits may be earned only in accordance with this agreement. In general, a credit can only be earned using the Hits Surf Click For Hits interface. Also, when a member takes advantage of the Head Hunter bonuses to introduce mew members to the Hits Surf advertising system.

Guaranteed Visitor

For purposes of this agreement a guaranteed visitor is defined as each time the Hits Surf website redirects a user to a member web site URL.

It is the responsibility of the member to make sure the provided URL is accessible.

To be a guaranteed visitor the member must have one unused credit available and choose to trade that credit for a Guaranteed Visitor.

Hits Surf can not specifically determin when a guaranteed visitor will visit any particular web site URL. Due to web site loading and member use the actual time is not available.

The Hits Surf advertising system makes a reasonable effort to provide consistent and quality service for its members. However, Hits Surf makes no guarantees of any kind regarding the dependability, accuracy, or timeliness of its services.

Ownership Rights

The Hits Surf Admin maintains ownership of all page source code, The Hits Surf Name, Logo, Database, Information, Software, and graphics. The member may under no conditions use or modify any copyrighted material in ways not stated in these terms and conditions. Any material owned or created by Hits Surf may be used only to promote the member referral URL for the purpose of introducing new members to Hits Surf.

Restrictions & Termination

A member may not artificially inflate:
• traffic counts
• credits
• click counters
• cash counters

If a Member provides inaccurate or dishonest information for fraudulent purposes;

If a Member is found promoting Hits Surf in violation of the CANN Spam Laws;

the Hits Surf Admin will immediately terminate the membership of any member that does not comply with all terms of this agreement. No credits or other account balances may be redeemed after an account is terminated by the Hits Surf Admin or Member, regardless of the reason for termination.

Risk and Liability

The member agrees to participate in the 1Hits Surf Advertising System at his/her own risk and agrees NOT to hold Hits Surf, its administrators, partners, employees, or sponsors liable for any damage or loss of information that may arise from the use of the Hits Surf services. The member agrees to defend, indemnify and hold the Hits Surf advertising system harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys’ fees) arising from the member’s violation of this Agreement or any third-party’s rights, including but not limited to infringement of any copyright, violation of any proprietary right and invasion of any privacy rights. This obligation will survive any termination of this Agreement.

Banned IP Addresses and Banned Domains

Hits Surf maintains a black list of banned IP addresses and banned domain names. Any known spammer or abuser of membership rights may be added to either or both lists at the discretion of Hits Surf.

The New member Signup Bonus Program

If a member signed up with the Cash Bonus offer they will have to do all of the following to qualify for the Bonus:
• Signup Using The Required Form
• Confirm the E-mail address by clicking on the URL that will be sent VIA E-mail
• A Member must have at least one Approved Web URL registered at Hits Surf as a Full Page View resource
• A Member must have at least one Approved Banner Ad resource registered at Hits Surf
• A Member must have at least one Approved Text Ad resource registered at Hits Surf
• A Member must view at least 300 pages during the first 30 days after becoming a member
• The Member will be credited with the bonus after all of the above is satisfied

Your relationship to Hits Surf

Your relationship to Hits Surf is one of an independent contractor and/or customer. No employee-employer relationship is created by your use of Hits Surf. You do not have any obligation to refer new members to the Hits Surf advertising system. Hits Surf HAS NO OBLIGATION TO OFFER HITS SURF OR OTHER PROMOTIONS TO YOU.
